ORDER

This Criminal Original Petition is filed to direct the learned Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, Madurai to accept the surrender of the petitioners and consider his bail application and grant bail on the same date of surrender itself in connection with the case in Crime No.15 of 2026, registered on 09.01.2026 on the file of the 2nd respondent police.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioners herein. The third respondent's daughter namely Nikitha and one Boopathi/A1 were in love for nearly 8 years. Now the petitioners are arranging the marriage of the first accused with some other woman. When the same was questioned by the daughter of the third respondent, the petitioners / accused Nos.1 to 3 insulted her. Hence the complaint in Crime No.15 of 2026 has been registered for the offences under Sections 296(b), 318(2) and 351(2) of BNS, 2023, read with Section 3(1)(r), 3(1)(s) of SC/ST (POA) Act, 1989.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, Madurai, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.15 of 2026 on the file of the 2nd 3/5

respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
