necessary steps to find out the petitioner's son by name R.Prakathi, D/o Rasu, aged about 26 years relating to the case in Crime No. 172/2024 on the file of the respondent No.5 in accordance with law. O R D E R

This petition is filed by the petitioner to direct the respondents 3 to 5 to take necessary steps to find the petitioner's daughter Pragathi, D/o.Rasu, relating to the case in Crime No.172 of 2024, on the file of the fifth respondent.

2. The learned counsel for the petitioner would submit that the petitioner is the mother of one Pragathi, D/o. Rasu and her daughter was missing from 03.06.2024. Thereafter, the petitioner lodged a complaint on 04.06.2024 before the fifth respondent and they registered a case in Crime No.172 of 2024 as "woman missing". Thereafter, they have not traced out the petitioner's daughter. In the meantime, the petitioner already filed a petition in H.C.P. (MD) No.1374 of 2024, before this Court and the same was disposed of on 02.12.2024, directing the fifth respondent to take Page No. 2 of 6

earnest efforts to tract out the petitioner's daughter. Thereafter, on 08.12.2024, the petitioner sent a detailed representation before the respondents 1 to 5, but, no action was taken. Therefore, the petitioner filed this petition.

The learned Government Advocate (Crl side) for the respondents would submit that after registering FIR, they examined witnesses, but still investigation is under process and further, they are unable to find any clue about the missing woman. Already, the petitioner filed H.C.P. (MD) No. 1374 of 2024, wherein the Hon'ble Division Bench of this Court, directed the fifth respondent to take efforts to find out the missing woman. They are also taking steps, but unable to trace out. The Special Team also constituted and cellphone tower signals of three suspected cellphones are still watching and that after obtaining the details, they will find out. Therefore, investigation is still pending and they will complete the investigation as early as possible.

4. The prayer sought for in this petition is to direct the third respondent to take steps to find out the petitioner's daughter, namely Pragathi, relating to the Crime No.172 of 2024. The fourth respondent Page No. 3 of 6

filed the status report that they are conducting investigation and they also examined some witnesses and report of Tower Tump of three suspected cellphones are called for from the concerned Authority and the same is awaited. Therefore, in this case, the investigation is still going on.

It is an admitted fact that already, the Hon'ble Division Bench of this Court in H.C.P.(MD) No.1374 of 2024, directed the fifth respondent to take earnest steps to trace out the petitioner's daughter. Since already the Hon'ble Division Bench has directed the fifth respondent, this Court once again need not to pass the same order. However, the respondents have to comply with the order passed by the Hon'ble Division Bench of this Court in H.C.P.(MD) No.1374 of 2024.

6. In view of the same, recording the abovesaid submission of the Government Advocate (Crl side), this Criminal Original Petition is disposed of.
