ORDER

This Criminal Original Petition is filed to direct the first respondent to comply with the order passed by the learned Judicial Magistrate No.2, Sattur in Crl.M.P.No. 290 of 2024 dated 27.03.2024 and thereby registering the complaint of the petitioner.

The learned counsel for the petitioner submitted that the petitioner lodged a complaint before the first respondent police on 01.06.2023 and since no action was taken, he has filed a petition in Crl.M.P.No. 290 of 2024 before the learned Judicial Magistrate No.2, Sattur and the same was disposed by directing the first respondent. Claiming that the order of the learned Judicial Magistrate No.2, Sattur, was not complied by the first respondent, this Criminal Original Petition came to be filed.

3. Learned Government Advocate(Crl.side) submitted that the first respondent police has issued summons by complying the order passed by the learned Judicial Magistrate No.2, Sattur, in Crl.M.P.No.290 of 2024 and they have promptly issued summons in the address given by the 2/4

petitioner. However, the same has been returned back as addressee not found. The petitioner may be directed to provide the correct address of the respondent.

In view of the submission of the learned Government Advocate, this Court directs the petitioner to forthwith provide proper address of the second respondent to the first respondent and on receipt of the same, the first respondent police is directed to issue summons under Section 64 BNSS and proceed in accordance with law and further conclude the investigation as directed by the Learned Judicial Magistrate, Sattur within a period of 4 months from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
