Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Declaration, declaring the action of the respondents in taking written undertaking dated 08.02.2013 from the petitioner to give up his statutory right under Section 47 (1) of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and the order of discharge passed by the 2nd Respondent in Ref : Tha. Aa. Po. Ka / Kumba / E2/143/2013 1/3

dated 31.08.2013 in discharging his services from the post of Conductor on medical grounds pursuant to the said undertaking as illegal and consequently direct the respondents to reinstate him in service with continuity of service and back wages and all other attendant benefits.

O R D E R

For non-compliance of the order of this Court, dated 04.01.2019, made in W.P(MD)No.17552 of 2014, this Contempt Petition is filed.

2.The learned counsel for the petitioner submitted that major portion of the terminal benefits were settled and only a sum of Rs.1,53,727/- has to be settled.

3.The learned Standing Counsel appearing for the respondents submitted that the respondents would undertake to pay the balance amount within a period of four weeks.

4.Recording the submission of the learned Standing Counsel appearing for the respondents, this Contempt Petition is closed. However, liberty is granted to the petitioner to revive the contempt petition, if the order of this Court is not complied with.
