No.5451/2017 dated 29.06.2017.

Prayer in CRL MP(MD). 8585/ 2017 in CRL OP(MD) No.5451 of 2017: To condone the absence of the petitioner with relates to the period from 22.07.2017 to 07.08.2017 on the condition imposed on the petitioner in Crl.O.P.(MD).No. 5451 of 2017 dated 29.06.2017 Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.V.MALAIYENDRAN, Advocate for the petitioner in both the petitions and of Mr.A.Ramar, Additional Public Prosecutor on behalf of the Respondent in both the petitions, the court made the following order:- The learned counsel for the petitioner is present. 2.Earlier when the matter came up for hearing on 12.09.2017, the learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner has failed to comply with the condition from 22.07.2017 to 07.08.2017. Hence, the petitioner https://hcservices.ecourts.gov.in/hcservices/ was directed to file a petition to condone the absence of the above

said days and also directed him to continue to comply with the earlier condition. Accordingly, a petition in Crl.O.P.(MD)No.8585 of 2017 is filed to condone the absence.

3.The learned Additional Public Prosecutor submitted that the petitioner is complying with the conditions till 07.08.2017 without fail and investigation has not been completed. 4.Considering the facts and circumstances of the case and considering the nature of charges, the earlier condition is relaxed and the petitioner shall appear before the respondent Police as and when required only on receipt of summons. These petitions are ordered accordingly sd/- 19/09/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
