Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing to the first respondent to pass appropriate final orders in the disciplinary proceedings initiated against the petitioner in memo No.DCS2/156137/97, dated 28.01.1998 and in memo No.DCS(OS)(3) 280978/96, dated 11.02.1998 by the then Director of Agriculture Chennai within a specified time frame that may be fixed by this Court.

2. By consent of both parties, the main writ petition is taken up for final disposal at the stage of admission itself.

3. The petitioner was working as Agricultural Officer. He reached the age of superannuation on 30.06.2007. He was however not allowed to retire. Instead he was placed under suspension. This was on account of the pendency of the criminal case in S.C.No.01/97, on the file of the Chief Judicial Magistrate/Sub Court, Tiruvannamalai. The said criminal case ended in acquittal on 14.03.2016.

4. Parallely, disciplinary action was initiated against the petitioner way back in the year 1998. Till date the final order has not been passed. The request of the petitioner that proceedings should conclude forthwith is reasonable.

5. Therefore this Court directs the first respondent to pass final orders on the disciplinary action initiated against the petitioner on or before 31.03.2018.

6. This Writ petition is disposed of accordingly. No costs.
