Order :This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.D.SASIKUMAR for M/s.M.SUBASH BABU, Advocate for the petitioner and of on behalf of the Respondents the court made the following order:- (Order of the Court was made by K.K.SASIDHARAN, J.) Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondent.

2. This Petition is to condone the delay of 46 days in filing a petition to set aside the order dismissing the Criminal Appeal for default.

3.The petitioner in the affidavit filed in support of the Miscellaneous Petition indicated the reasons for the delay in filing the application.

4.In view of those reasons, we deem it fit to condone the delay of 46 days in filing the application to set aside the order dismissing the Criminal Appeal for default. Accordingly, the delay is condoned.
