ORDER

This writ petition has been filed for a Mandamus seeking for a direction to the second respondent to conduct enquiry and to issue patta under the Patta Pass Book Act for the house site situated in Natham Survey No.1933, measuring about 414 Square Feet at Vadamadurai Village, Vedasendur Taluk, Dindigul District, based on the petitioner's representation dated 19.01.2022 within a time frame to be fixed by this Court.

2. It is the case of the petitioner that he is the absolute owner of the aforementioned property and he is in possession of the same. He has applied for patta on 19.01.2022 with the second respondent for the said property. Since the said application has not been considered till date, he has filed this writ petition.

3. Heard Mr.S.Sarvagan Prabhu, learned counsel for the petitioner and Mr.B.Saravanan, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

4. No prejudice would be caused to the respondents, if the petitioner's application seeking for issuance of patta for the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.3619 of 2022 aforementioned property is considered on merits and in accordance with law after affording a fair hearing to the petitioner and other rival claimants, if any.

Accordingly, this Court directs the second respondent to consider the petitioner's application dated 19.01.2022 seeking for issuance of patta in his name for the property situated in Natham Survey No.1933, measuring about 414 Square Feet at Vadamadurai Village, Vedasendur Taluk, Dindigul District and pass final orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order after affording a fair hearing to the petitioner and other rival claimants, if any.

6.With the aforesaid directions, this writ petition stands disposed of. No costs.
