PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the Respondent No.1 and 2 to provide police protection to the petitioner for carrying on his lawful business (water paper and iron) at F.No.9, V.R.S.Ratna Avenue, Town, Karambai Road, Keelvasal, Thanjavur District and protect the life and limb of the petitioner from the hindrance of 7th and 8th Respondent by considering the representation of the petitioner dated 01.02.2025. O R D E R

This writ petition has been filed seeking direction to direct the Respondent Nos.1 and 2 to provide police protection to the petitioner for carrying on his lawful business (water paper and iron) at F.No.9, V.R.S.Ratna Avenue, Town, Karambai Road, Keelvasal, Thanjavur District and protect the life and limb of the petitioner from the hindrance of 7th and 8th Respondent by considering the representation of the petitioner dated 01.02.2025.

2. The learned Government Advocate appearing for the 3 to 6 respondents would submit that the petitioner causing pollution by dumping waste material and thereby the petitioner causing disturbance to the public in the name of waster paper and iron business.

3. The learned Additional Public Prosecutor appearing for the respondent Nos.1 & 2 would submit that the respondent police received a representation of the petitioner on 01.02.2025 and thereby they enquired the matter and closed the same.

4. Considering the limited scope of prayer sought for in this petition and without issuing any notice to the private respondents, this Court is inclined to pass orders in this writ petition.

5. According to the petitioner, he is running a business of waster paper and iron, the respondent Nos.7 and 8 causing disturbance to the business of the petitioner. Therefore, he lodged a complaint on 01.02.2025 for seeking police protection. According to the respondent Nos.1 and 2, already representation of the petitioner was considered and the same was Page No. 3 of 6

closed. This Court cannot direct the respondent police to give police protection for running business in all cases in a routine manner. But, at the same time, if anybody involved in any criminal activities, the petitioner is at liberty to approach concerned police by lodging appropriate complaint and if any such complaint is given by the petitioner, it is for the second respondent to consider the same on merits and in accordance with law.

6. With the above observations and directions, this Writ Petition is disposed of. No costs.
