2016-02-01Honourable Mr Justice V. S. Ravi2 pages

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Monday, the First day of February Two Thousand Sixteen PRESENT The Hon`ble Mr Justice V.S.RAVI CRL MP(MD) No.566 of 2016 IN CRL A(MD) No.338 of 2014 1 BALASUBRAMANIAN 2 CHINNIAH 3 RANI 4 BHARATHI ... PETITIONERS/PETITIONERS/APPELLANTS Vs STATE REP.BY THE INSPECTOR OF POLICE KEERAMANGALAM POLICE STATION, PUDUKKOTTAI DISTRICT. (CR.NO. 68/2007) ... RESPONDENT/RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed in M.P.(MD) No. 1 of 2014 in Crl.A. (MD) No. 338 of 2014 dated 30.12.

2014 on the file of this Honourable High Court Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S D.RAMESHKUMAR, Advocate for the petitioner and of Mr.P.Kandasamy, Government Advocate on behalf of the Respondents the court made the following order:- This is an application filed by the petitioners to relax the condition imposed in M.P.(MD).No.1 of 2014 in Crl.A.(MD).No.338 of 2014, dated 30th December 2014.

2. On 30th December 2014, this Court had passed an order that the petitioner shall report before the Court on the first wording day of every month till the disposal of the appeal.

3. On perusal of the said order, it is seen that only minimum condition has been imposed by this Court for granting suspension of sentence. If that minimum condition is also relaxed, then parties used to forget the case and there is no further proceedings taken in the Criminal Appeal (MD).No.338 of 2014, for the disposal of the case, on merits. Further, there is no valid ground made in the petition to entertain the petition and also to grant the relaxation of the minimum condition already imposed. In such circumstances, this Court is not inclined to grant any more relaxation of the condition already imposed by this Court in M.P.(MD).No.1 of 2014 in Crl.A.(MD).No.338 of 2014. Hence, this petition is not maintainable and the same is dismissed. sd/- 01/02/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
