CR.NO. 9 OF 2016 ... RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed in Crl.O.P.No.8201 of 2016 dated 19.05.2016.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.V.KANNAN, Advocate for the petitioner and of Mr.K.ANBARASAN, Government Advocate (Crl. Side) on behalf of the Respondent, the court made the following order:- This application is filed seeking relaxation of the condition imposed in Crl.O.P.(MD).No.8201 of 2016 dated 19.05.2016.
2. The petitioner was charged for the offences under Sections 417, 376 of I.P.C., and Section 4 of TNPWH Act and he was arrested on 14.03.2016 and he filed Crl.O.P.(MD).No.6516 of 2016 for bail and the same was dismissed on 20.04.2016. Subsequently, the petitioner has filed Crl.O.P.(MD).No.8201 of 2016 for bail and this Court, by order dated 19.05.2016, granted bail directing the petitioner to appear before the respondent police daily at 10.00 a.m. and 5.00 p.m. until further orders. Now, the petitioner has come out with the present petition for relaxation.
3. The learned Government Advocate (Crl.side) submitted that the petitioner has complied with the condition only from 25.06.2015 to 11.07.2016. Thereafter, he did not comply with the condition and even after giving adjournment on 19.07.2016, directing him to appear before the respondent police, he did not appear before the https://hcservices.ecourts.gov.in/hcservices/
respondent police till date violating the condition imposed by this Court. Hence, he prayed for dismissal of the petition.
4. In view of the fact that the petitioner did not appear before the respondent police after 11.07.2016, this Court is not inclined to relax the condition imposed by this Court. Accordingly, this petition is dismissed sd/- 02/08/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
