Heard both sides.
2. We are not happy with the choice of the site for putting up the water tank. However, considering the fact that huge public money has already been spent for putting up the water tank, we are not directing its demolition.
3. The learned counsel appearing for the petitioner states that while putting up the water tank, the bund has been destroyed. We direct the respondents to restore the bund portion. We also direct the respondents 1 and 2 to ensure that such lapses do not occur in future. The learned Special Government Pleader is directed to bring this direction to the notice of respondents 1 and 2. This writ petition stands disposed of accordingly. No costs.
