PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for an alleged offence punishable u/s 339, 505 IPC and Sec.66A of Information Technology Act, 2008 in Cr.No.78 of 2015 and CR.No.27 of 2015, seeks anticipatory bail.
2. Heard Mr.RM.Arun Swaminathan, learned counsel for the petitioner and Mr.A.P.Balasubramanian, learned Govt.Advocate [crl.side] appearing for the State.
3. The de facto complainants in this case are the Principals of Leaders Matriculation School and Chellappan Vidya Mandir of Karaikudi. In their complaints they has stated that, this petitioner and one Rajkumar who are members of an NGO have been spreading false news to the effect that, the children of the School have been affected by an alleged gas leak from a nearby Chemical Company. The news planted by this petitioner in the Facebook and other social media created a great panic amongst public and parents in the area.
4. The learned counsel for the petitioner submits that they are social workers and they have been falsely implicated. The learned counsel also submitted that other accused Rajkumar is in Singapore. Even according to the learned counsel for the petitioner, one of the accused, who is sitting in Singapore is trying to create panic in villages in India with the help of this petitioner and is creating serious law and https://hcservices.ecourts.gov.in/hcservices/
order problem for the Indian authorities. Taking into consideration the serious nature of allegations against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, these Criminal Original Petitions stand dismissed.
