O R D E R

As per claim of the petitioner, he is entitled for terminal benefits to the tune of Rs.6,66,708/-. According to the respondents, the petitioner is entitled to the tune of Rs.3,99,967/- and the respondents have already paid a sum of Rs.2,13,524/- and the balance payable is Rs.1,86,443/-. 2/6

2. The respondents are directed to disburse a sum of Rs.1,86,443/-within a period of One week from the date of receipt of a copy of the Order.

3. As far as the balance amount is concerned, the Learned Counsel appearing for the respondents submitted that they had already adjusted the surcharge proceedings which was conducted against the petitioner and the same was adjusted based on the audit report.

4. The Learned counsel appearing for the petitioner submitted that a Surcharge proceeding was initiated against the petitioner and the same was also quashed by this Court. In such circumstances, the respondents cannot adjust the same. The respondents have also accepted that the Surcharge proceeding was quashed by this Court.

5. Therefore, the respondents are directed to reverse the audit report, within a period of Eights weeks from the date of receipt of a copy of the order and pay the balance amount, within a period of two weeks, thereafter. 3/6

6. With the above directions, this Contempt Petition is closed. In case, if the order is not complied with by the respondents, the petitioner is at liberty to reopen this Contempt petition.
