Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of certiorarified mandamus, to call for the records pertaining the impugned order passed by the fourth respondent in PR-49/F1/2018 dated 25.04.2019, quash the same and consequently direct the respondents to reinstate the petitioner into services.

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. Though the petitioner has sought for quashing the order of the fourth respondent dated 25.01.2019, imposing the punishment of removal of service, the learned counsel for the petitioner would https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.3861 of 2020 submit that he would be satisfied if a direction is given to the first respondent to consider the petitioner's representation dated 13.01.2020, wherein he has sought for cancellation of original punishment issued in view of the subsequent order of acquittal dated 25.09.2019, passed by the criminal Court. The representation made by the petitioner is in the form of an appeal under Rule 5 of the Tamilnadu Police Subordinate Service (Discipline and Appeal) Rule.

3.In view of the submission made by the learned counsel for the petitioner and without going into merits of the claim made by the petitioner, there shall be a direction to the first respondent herein to consider the petitioner's representation, dated 13.01.2020, on its own merits and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order.

4. With the above directions, this Writ Petition is disposed of. No costs.
