PRAYER:- Petition filed under Article 226 of the Constitution of India seeking a Writ of Certioari, to call for the records pertaining to Notification No.01/2021, dated 10.02.2021 issued by the first respondent and quash the same as illegal. For Petitioner :Mr.M.Ramesh For Respondents :Mr.M.Sricharan Rangarajan Additional Advocate General assisted by Mr.P.Mahendran Additional Government Pleader **** COMMON ORDER The notification, dated 10.02.2021, issued by the Government Litigation Department, calling for applications to fill up 16 posts of Office Assistants in the Government Pleaders Office, is put to under challenge in this Writ Petition. 2.The main ground raised by the petitioner is that the last date for applying for the said post is on 22.02.2021. However, the respondents have sent call letters on 20.02.
2021 for conducting interviews and calling upon the candidates to appear for the interview on 24.02.2021. The proof of dispatch, evidencing that the call letter was sent on 22.02.2021 at 03.30 pm, is produced before this Court. In both these Writ Petitions, the petitioners' claim that they had received the call letter only on 24.02.2021 and therefore, they were unable to appear for the interview scheduled to be held on 24.02.2021 at 10.30 am. 3.The learned Additional Advocate General, on instructions, submitted that there have been similar complaints from other candidates also expressing their inability to appear for the interview, since the call letters were received after the schedule time for the interview.
Therefore, the respondents have, in principal, taken a decision to postpone the conduct of the personal interview to a subsequent date, after the Model Code of Conduct for the General Election-2021, is lifted. It is their further submission that the original notification, dated 10.02.2021 shall remain in force. In other words, the respondents intend to conduct a fresh interview to all the eligible candidates by sending fresh call letters to such eligible candidates. 4.In view of the same, the ground, on which the petitioner seeks to quash the notification, has become redundant and they may not have any further grievance, since they are likely to be called for an interview at a later point of time. Hence, no useful purpose will be served by keeping these present Writ Petitions pending.
