O R D E R

This Writ Petition is filed directing the first respondent herein to hear and dispose of the pending appeal in Na.Ka.A2/2150/2025 filed by the petitioner by way of representation dated 17.03.2025 under Section 12 of the Tamil Nadu Patta Pass Book Act, 1983, with respect to the property bearing in Re.S.no.1093 in T.S.No.390 to an extent of 12,875 Sq. Ft., in Plot No.297 in 470 Kurukkam Layout in Block No.33, Ward No.3 in Karaikudi Town and Taluk, Sivagangai District.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 3 and 4, notice to the respondents 3 and 4 is hereby dispensed with.

According to the petitioner, he has filed an Appeal petition dated 17.03.2025 before the first respondent to challenge the order passed by the Deputy Tahsildar, Karaikudi Taluk, in proceedings Mu.Mu.Di.Mu.Di.No.336/96-97 dated 18.10.1996. Despite filing of the Appeal petition, the first respondent has not taken any action to consider or dispose of the same, causing undue hardship and prejudice to the petitioner.

5. The petitioner submits that prompt disposal of the Appeal is necessary to protect his rights and avoid any further prejudice arising from the order challenged. Hence, the present Writ Petition.

6. The learned Special Government Pleader for the respondents 1 and 2 submits that the petitioner's appeal petition will be considered on its merits and in accordance with law.

7. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal 3/6

petition in Na.Ka.A2/2150/2025 dated 17.03.2025, on merits and in accordance with law and pass appropriate orders within a period of sixteen (16) weeks from the date of receipt of a copy of this order. The appeal shall be considered and disposed of after conducting an enquiry. The first respondent is directed to provide reasonable opportunity during such enquiry to the petitioner, respondents 3 and 4 and also to the other persons, who may be affected by such decision. Needless to state, the petitioner shall make himself available for the purpose of the enquiry. There shall be no order as to costs.
