PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents no.5 to 7 to provide adequate police protection for peaceful conduct of the Mahasivarathiri Festival at Sri Gengaiamman Kovil Temple, Vepillai Village, Sattur Taluk, Virudhunagar scheduled to be conducted on 26.02.2025, 27.02.2025 and 28.02.2025 by considering the representation of the petitioner dated 25.01.2025. This Writ Petition has been filed to direct the respondents No.5 to 7 to provide adequate police protection for peaceful conduct of the Maha Sivarathiri festival at Sri Gengaiamman Kovil Temple, Vepillai Village, Sattur Taluk, Virudhunagar scheduled to be conducted on 26.02.2025, 27.02.2025 and 28.02.2025 by considering the representation of the petitioner, dated 25.01.2025. 2.Heard the learned counsel on either side and perused the materials available on record.

3.According to the petitioner, there are some misunderstandings between the village people in respect of giving first priority in the temple. In this regard, a civil suit was filed by the petitioner in O.S.No.162 of 1995 and the same was went up to second appeal in SA(MD) No.491 of 2006 and the same was allowed on 29.07.2024 in favor of the petitioner. However, there are some disputes between the petitioner and the private respondents in respect of performing pooja and giving first priority. The private respondents are creating law and order problem. To avoid such disputes, the petitioner has sent a representation to the respondents on 25.01.2025 and the same was not considered. Hence, this petition has been filed. 4.

The learned Government Advocate appearing for the respondents 1 to 4 submitted that already there is a dispute between the parties with regard to the administration of the temple, thereby, if the festival is conducted, the same would create law and order issue. 5.The learned Government Advocate (Crl.

the petitioner has not furnished the relevant particulars. However, on account of Maha Sivarathiri festival, the respondent police would provide necessary police protection to the public. 6.Though the representation given by the petitioner with regard for giving first priority was already closed by the 7th respondent, the respondent police is ready to give police protection during Maha Sivarathiri festival. In view of the same, this Writ Petition stands closed by recording the aforesaid submission of learned Government Advocate (Crl.Side).
