Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.PRABU , Advocate for M/S.POLAX LEGAL SOLUTIONS, Advocate for the petitioner and of Mr.C.MAYILVAHANA RAJENDRAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition is filed seeking to relax the condition imposed by this Court in Crl.M.P.(MD).No.2296 of 2017 in Crl.A.(MD).No.88 of 2017, dated 16.03.2017.
2.Earlier this Court granted suspension of sentence to the petitioner in Crl.M.P.(MD).No.2296 of 2017, with a condition that the petitioner/appellant should appear before the Trial Court on the first working day of every English Calender month at 10.30 a.m., until further orders.
3.The learned counsel appearing for the petitioner submitted that the petitioner is arrayed as A2 and A1 already died. He further submitted that the petitioner is a widow and she is having three children and she is residing at Chennai and on 16.03.2017, this https://hcservices.ecourts.gov.in/hcservices/
Court imposed a condition that the petitioner is directed to appear before the learned Special Judge (Vigilance and Anti-corruption Cases), Trichy, once in a month and she is not able to appear before the trial Court, since she is residing at Chennai and hence, he sought for relaxing the said condition.
4.The learned Additional Public Prosecutor appearing for the respondent Police submitted that the petitioner is complying with the conditions imposed by this Court in Crl.M.P.(MD).No.2296 of 2017 in Crl.A.(MD).No.88 of 2017 dated 16.03.2017. 5.Considering the facts and circumstances of the case and also considering the submissions made by the learned counsel for the petitioner, the earlier condition is modified to the effect that the petitioner shall appear before the learned Special Judge (Vigilance and Anti-corruption Cases), Trichy once in three months on the first working day at 10.30 a.m., until further orders. sd/- 20/09/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.)
