PRAYER: The petition filed under Section 24 R/w Sec 151 of CPC., of the Civil Procedure Code, to withdraw the case in G.W.O.P.No.183 of 2021 on the file of the Family Court, Karur and to transfer the same to the Family Court, Trichy.

ORDER

This Petition is filed to withdraw the case in G.W.O.P.No.183 of 2021 from the file of Family Court, Karur and transfer the same to the file of Family Court, Trichy.

2.The learned counsel for the petitioner submitted that G.W.O.P.No.183 of 2021 was filed by the respondent/husband before the Family Court, Karur and also filed HMOP.No.79 of 2021, for seeking restitution of conjugal rights before the Subordinate Court, Kulithalai. He further submitted that HMOP.No.66 of 2021 was filed by the petitioner/wife, for dissolution of marriage before the Subordinate Court, Kulithalai. Since the petitioner is residing at Trichy, she cannot go to Karur to attend the Court hearings. Hence, she seeks to transfer the case.

3.Mr.V.Karuna, the learned counsel appearing for the respondent has no objection to transfer the case.

4.Considering the facts and circumstances of the case and also considering the submission made the learned counsel for the petitioner, G.W.O.P.No.183 of 2021 is ordered to be withdrawn from the file of Family Court, Karur and transferred to the file of Family Court, Trichy.

T.R.C.M.P(MD)No.87 of 2022 5.In the result, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
