Respondents Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order passed by the first respondent in Roc.No.A2/8459/2017 dated 03.11.2017 and quash the same and consequently directing the first respondent to reinstate the petitioner with all back wages.

Heard the learned counsel on either side.

2.By consent of both the parties, the main Writ Petition is taken up for final disposal.

3.The petitioner was working as Village Administrative Officer. He was implicated in Crime No.608 of 2017, on the file of Karaikudi North Police Station. He was suspended from service vide order dated 03.11.2017. The order of Suspension reads that an enquiry into grave charges against him is contemplated. Subsequently, charge memo has been issued on 07.11.2017. The order of suspension cannot be said to be one without jurisdiction. However, a direction can be given to the first respondent to speedily conclude the disciplinary action initiated against the petitioner.

4.It is relevant to note that the petitioner has already given his explanation. The first respondent is directed to consider the petitioner's explanation. If the first respondent finds the explanation to be satisfactory, he can very well drop further https://hcservices.ecourts.gov.in/hcservices/

action. If the first respondent proposes to hold an enquiry against the petitioner, the same shall be concluded on or before 31.03.2018.

5.With this direction, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
