RESPONDENT/RESPONDENT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honble Court in Crl.OP.(MD).No.382 of 2024, dated 10.1.2024 in so far as the condition No.6(b) as directing the Petitioner to constrict a toilet to the Government Higher Secondary School, Allinagaram, Sivagangai District instead of constructing a toilet to the Government Girls Higher Secondary School, Thirupuvanam, Sivagangai District.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.A.BALAJI, Advocate for the petitioner and of Mr.P.KOTTAICHAMY, Government Advocate(Crl.side) on behalf of the Respondent, the Court made the following order:- 1/4

This Petition has been filed to modify the condition imposed by this Court in Crl.O.P.(MD)No.382 of 2024, dated 10.01.2024 insofar as the condition No.6(b) as directing the petitioner to construct a toilet to the Government Higher Secondary School, Allinagaram, Sivagangai District instead of constructing toilet to the Government Girls Higher Secondary School, Thirupuvanam, Sivagangai District. 2.Heard both sides.

3.Considering the reasons assigned in the affidavit filed in support of this petition, the condition already imposed on the petitioner in Crl.O.P.(MD)No.382 of 2024, dated 10.01.2024 in condition No.6(b) is modified to the effect that "since the petitioner on his own volition, undertakes to construct a toilet to the Government Higher Secondary School, Allinagaram, Sivagangai District, he is directed to construct a toilet to the said school, within a period of six weeks from the date of receipt of a copy of this order. The Head Master of the said school shall co-operate with the petitioner for construction of toilet for the benefit of girl students. After construction of toile, an appropriate proof shall be sent to the concerned learned Judicial Magistrate by the Headmaster of the said School. The petitioner shall file a photograph before this Court, after construction of toilet to the said school."

4.This Criminal Original Petition is ordered accordingly. 5.The time for execution of sureties is extended by two weeks from the date of receipt of a copy of this order.
