ORDER
This Transfer Petition invoking Section 24 of C.P.C is filed at the instance of wife. She seeks withdrawal of H.M.O.P.No.680 of 2023 from the file of Family Court, Pondicherry and transfer the same to the file of Family Court, Madurai.
2. Heard Mr.R.Babu Jeganath, learned counsel for petitioner and Mr.R.Saravanan, learned counsel for respondent.
3. Petitioner married the respondent on 27.06.2022, according to Hindu rites and customs. Due to differences, parties have separated. It is the case of wife that she would have to travel a distance of more than 325Kms from Madurai to Family Court, Pondicherry, to effectively defend the case filed against her by the husband/respondent. That apart, she contended that there is a life threat to her.
4. Learned Counsel for the respondent/husband undertakes that there would not be any form of threat to the Wife by him or his family members, and he has made an endorsement to that effect in the court record.

In order to expedite the disposal of the pending case, it is agreed that instead of transferring it, the Husband would pay the costs in advance that may be determined by the Family Court, Pondicherry, for the travel of the Wife whenever her personal appearance is required in the case. In respect of other hearing, the Wife shall be entitled to appear through Video-conferencing facility in the Trial Court, if she is not able to attend physically. Consequently, both parties shall appear before the Family Court, Pondicherry, for conduct of further proceedings from its present stage and on the subsequent dates to which it is adjourned from time to time on the aforesaid terms till final order is passed.
6. In the result, the Transfer Miscellaneous Petition is disposed of on the aforesaid terms. Consequently, connected miscellaneous petition is closed. No costs.
