Third time the wife of the petitioner has eloped. Expressing concern about the children, present HCP is filed by the father of the children.

Learned Additional Public Prosecutor states that it has become a routine to the petitioner as well as his wife to desert and file complaints. This is the third in the row. Hence, this Court finds that Habeas Corpus jurisdiction cannot be misused when there is efficacious remedy for the petitioner herein.
