IN CR.NO.347 OF 2017. RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the conditions imposed on the petitioner in Crl.O.P.(MD) No.10338 of 2017 dated 08.08.2017 and thus render justice. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.SELVAKUMARAN, Advocate for the petitioner and of MR.T.MOHAN, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The learned counsel for the petitioner is present. 2.The learned Additional Public Prosecutor appearing for the respondent Police submitted that the petitioner is complying with the conditions imposed by this Court in Crl.O.P(MD).No.10338 of 2017 from 31.08.
2017 to till 09.10.2017. The respondent police has also produced the note book, in which shows the regular compliance of the petitioner herein. He further submitted that the charge sheet was filed before the learned Judicial Magistrate, Uthamapalayam on 21.09.2017 but not taken on file.
3.The defacto complainant is present and he is the father of the petitioner, petitioner born through the first wife of the defacto complainant. Petitioner is an Advocate. 4.Considering the facts and circumstances of the case, this Court is inclined relax the condition as prayed for and the petitioner shall appear before the concerned Court on receipt of summons. 5.The petitioner is directed not to disturb the defacto complainant in any manner, as undertaken given by the counsel for the petitioner in open Court, since the defaco complainant appeared in person at the hearing of this petition and has withdrawn his petition today for cancellation of anticipatory bail already granted to the petitioner.
