For Appellants : Mr.Raja Karthikeyan For Respondents : Mr.Veerakathiravan Addl. Advocate General assisted by Mr.S.P.Maharajan Spl. Govt. Pleader for R1 to R3 *** COMMON JUDGMENT (Judgment of the Court was delivered by R.SUBRAMANIAN, J.) The question sought to be raised in this writ appeal is covered by the Judgment of this Court in D.Aravinda vs. The Government of Tamil Nadu reported in CDJ 2009 MHC 3933.

2.From the reading of the above said Judgment of the learned Single Judge of this Court, we find that the Rule position has been correctly interpreted and it has been found that the Direct Recruits cannot have grievance when the cases of the promotees are concerned. The Hon'ble Division Bench of this Court in W.A(MD)Nos.1334 and 1335 of 2009, has upheld the promotion 4/6

orders passed relying upon the Judgment of the D.Aravindan's case. We, therefore, see no need to revisit the Rule position which will create further confusion.
