Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the Respondent Police to file the final report before the District Munsif Cum Judicial Magistrate, Ottapidaram in Crime No.38 of 2023 pending investigation on the file of the Respondent Police.

ORDER

The learned Counsel for the Petitioner submitted that the Petitioner is a senior citizen. He is the De-facto Complainant in Crime No.38 of 2023 dated 20.02.2023 for the offences punishable under Sections 441, 379 of IPC on the file of the Respondent Police. He had filed this petition seeking direction against the Respondent Police to complete the investigation in Crime No.38 of 2023 and final report.

The learned Government Advocate (Criminal Side) on instructions of the Respondent would submit that based on the complaint of the Petitioner, the Respondent Police had issued summons to the Petitioner to enquire him regarding allegations made by him. After receiving summons, he did not appear before the Respondent Police. If the Petitioner is ready to co-operate with the Respondent Police, then the Respondent Police is ready to complete the investigation within a limited time.

3. Recording the submission of the learned Government Advocate (Criminal Side), the Petitioner is directed to co-operate with the pending 2/4

investigation. The Respondent Police is directed to issue proper summons specifying the date and time for appearance of the Petitioner and also directed to complete the investigation within a reasonable period of three (3) months from the date of receipt of a copy of this order.
