The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 64(1) & 351(2) of BNS 2023, [corresponding sections 376 & 506(1) of IPC], in Crime No.51 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the first petitioner was in illicit relationship with the victim who is the sister of the defacto complainant and cheated her. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution and the victim was in relationship with A1 and the petitioner is A2 and he is arrayed as an accused but no evidence to prove the same and he has nothing to do with the present case. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the 2/4

petitioner.

4. The learned Government Advocate(Crl. side) produced the 164 statement of the victim girl and he opposed for grant of anticipatory bail to the petitioner.

5. Perusal of 164 statement which is recorded by the Judicial Magistrate in the presence of psychiatric assisted counselling in which the victim clearly stated that the petitioner also involved with the crime and committed penetrative sexual assault. Considering the same, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
