The petitioner's application, dated 20.11.2017, seeking for issuance of Indian Passport, has been kept pending by the first respondent in view of pendency of an F.I.R., in Crime No.15 of 2016, dated 08.01.2016, on the file of the third respondent - Police.
2. Today (i.e.17.04.2018), this Court by an order passed in W.P.(MD) No.23446 of 2017 had observed that mere pendency of an F.I.R., cannot be construed as pendency of criminal proceedings and as such, had set aside the show-cause dated 23.11.2016 and https://hcservices.ecourts.gov.in/hcservices/
consequently directed the Passport Authority to return back the Passport to the petitioner therein.
3. In view of the order passed by this Court in W.P.(MD) No.23446 of 2017, no further orders are required in the present writ petition. Accordingly, the present writ petition stands closed. No costs.
