Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to pay interest at the rate of 8% per annum for the delay in payment of arrears of pension, for the period 2010-2011 and 2011-2012, as per the VI Pay Commission, to the petitioner. ORDER

Heard the learned counsel on either side.

2.By consent of both the parties, the main Writ Petition itself is taken up for final disposal.

3.The petitioner is a retired employee of Highways and Rural Works Department. He retired in September 1997. Following the implementation of the Sixth Pay Commission, recommendations the petitioner's pension was revised. The Authorities agreed to disburse the arrears of pension and other benefits in three installments. The first installment alone was paid in time. 4.Therefore, the Authorities are bound to pay interest for such belated payment of the arrears of pension. In this regard, the petitioner submitted more than one representation. 5.The first respondent is directed to quantify the interest payable to the petitioner at 8% per annum and pay the same within the period of 12 weeks from today.
