ORDER : The Court Made the following order :- Initially, this petition was filed showing the Crime number as not known. Therefore, this Court granted interim anticipatory bail to the petitioner on 23.02.2015 with a direction to the petitioner to report before the respondent police at 6.30 p.m.
2. Today, the respondent police is present and they filed a status report. It is stated in the status report that the petitioner complied with the order passed by this Court and appeared before the respondent police for investigation on 07.03.2015. A regular case in Crime No.87 of 2015 has been registered by the respondent police for offences under Sections 147, 294(b), 323 and 506(i) of I.P.C. on 05.03.2015.
3. On a reading of the complaint, it is alleged by the complainant that the petitioner slapped him. There appears to be business rivalry between the petitioner and the de-facto complainant. There is no previous case against the petitioner.
4. Under such circumstances, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail, in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Trichy on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that, https://hcservices.ecourts.gov.in/hcservices/ (a) the petitioner shall report before the respondent police daily at 6.30 p.m. for a period of two weeks and thereafter as and when required for interrogation.
[b] the petitioner shall give his thumb impression, specimen signature and handwriting.
[c] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[d] the petitioner shall not abscond either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
