ORDER

The petitioner / Accused, who was arrested and remanded to judicial custody on 19.01.2026 for the offences punishable under Sections 409, 465, 466, 468 and 477A IPC and Sections 66C and 66D of Information Technology Act 2000 in Crime No.27 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner, who is working as a contract employee in Madurai Corporation, and the other accused, by misusing the official login credentials, had reduced property tax for more than 150 buildings between 01.04.2022 and 31.07.2024 and caused loss to the tune of Rs.1.5 crores to Madurai Corporation and on 06.09.2024, after coming to know about the irregularities in the records of Urban Tree Information System (UTIS), the Commissioner, Madurai Corporation lodged a complaint before the Commissioner of Police, Madurai City and the same was received on 10.09.2024 by the Commissioner of Police, Madurai City, who in turn forwarded the complaint to the City Crime Branch and after enquiry, FIR was registered on 17.06.2025 in Crime No. 27 of 2025 against the officers working in Madurai Corporation, who know the User ID and password for the work of imposition and revision of tax. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is not 2/6

present in the scene of occurrence, a false case has been given. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and she is in judicial custody from 19.01.2026. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that co-accused in the present case have already been granted bail. He further submitted that 78 beneficiaries are yet to be enquired and that investigation is in crucial stage. Hence, he opposed for grant of bail to the petitioner.

Taking into consideration of the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioner and the fact that co-accused had already been released on bail, this Court is inclined to grant bail to the petitioner, subject to the following conditions:

6. Accordingly, this Petition is allowed and the petitioner is ordered to be released on bail on executing a bond for a sum of 3/6

Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai, and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders.

[c] the petitioner shall not abscond either during investigation or trial.

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
