PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, direct the respondent No. 1 to 3 to provide adequate police protection to the petitioner and petitioner's family members on the basis the petitioner's representation dated 25.02.2025 in accordance with law. ORDER

This writ petition has been filed seeking for a direction to the respondents 1 to 3 to provide adequate police protection to the petitioner and her family members, on the basis the petitioner's representation dated 05.02.2025 in accordance with law.

2. Considering the nature of the order going to be passed in this writ petition, notice to the private respondents is dispensed with. 2/6

The learned counsel appearing for the petitioner would submit that the petitioner purchased the land in S.No.143/1, situated at Kullur Snathai Village, Aruppukottai Taluk, Virudhunagar District, through sale deed dated 18.04.2024 and she made an application for survey of the said property and survey was also conducted by the concerned Tahsildar. While so, when the petitioner tried to install the boundary stones as per the survey measurements, the private respondents restrained the petitioner from installing the boundary stones. Therefore, the daughter-in-law of the petitioner namely, Selvi, gave a complaint before the third respondent as against the private respondents and CSR No.276 of 2024 was assigned. Thereafter, no action was taken. Again, the petitioner, on 05.02.2025, sent a detailed representation to the respondents 1 to 3. However, the respondents have not taken any steps. Hence, this petition came to be filed.

The learned Additional Public Prosecutor appearing for the official respondents would submit that there is a property dispute pending between the petitioners' family and the private respondents' family and thereby, the petitioner, after survey of the subject property, attempted to install the boundary stones and 3/6

the same was restrained by the private respondents. The daughter-in-law of the petitioner has already given a complaint on 10.08.2024 and CSR No.276 of 2024 was also assigned and thereafter, it was closed as civil in nature. Again, the petitioner sent a representation dated 05.02.2025 with same set of allegations and now, the said representation is under consideration and the respondents will conduct enquiry and dispose of the same within a period of one week.

5. This Court heard the learned counsel on both sides and perused the records placed before this Court.

Since the representation of the petitioner is under consideration and enquiry is pending with the third respondent, without going into the merits of the case, this Court directs the third respondent to conduct an enquiry on the representation of the petitioner dated 05.02.2025 on merits and dispose of the same in accordance with law, within a period of one week from the date of receipt of a copy of this order.

7. With the above direction, this writ petition is disposed of. No costs. 19.02.2025 Index :
