For Respondent : Mr.E.Antony Sahaya Prabahar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.125 of 2016 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 364,302,120(B) of IPC, 341 r/w.34 of IPC in Crime No.125 of 2016, seeks anticipatory bail.
2. The learned counsel for the petitioner would submit that NBW was issued against the petitioner on 18.11.2019, since then it is pending. He would further submit that he will regularly appear before the trial Court and ready to co-operate for conduct of the trial
3. When the matter came up for hearing on 08.04.2021 this Court called for report from the learned III Additional District Judge, Tirunelveli with regard to the stage and reasons for pendency of the case.

4. It is seen from the case diary that as per the direction of this Court in Crl.O.P(MD)No.4710 of 2021 steps have been taken to split up the case against A1.
5. Inview of the same, this Court directs the petitioner to surrender before the learned III Additional District Judge, Tirunelveli within a period of two weeks from the date of receipt of copy of this order and to file a petition to recall the NBW issued against them. The learned III Additional District Judge, Tirunelveli is directed to consider the same on merits and in accordance with law and pass orders on the same day. The main case to be disposed at the earliest.
