PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure to withdraw the H.M.O.P.No.107 of 2020 on the file of Family Court, Madurai and to transfer the same to the file of Sub Court, Uthamapalayam, Theni District.

This petition was filed seeking transfer of H.M.O.P. 107 of 2020 now pending on the file of the Family Court, Madurai to the file of Sub Court, Uthamapalayam, Theni District. The said H.M.O.P.No. 107 of 2020 has been filed by the husband for restitution of conjugal rights.

2. The respondent has not turned up. The travelling distance between the Madurai and Uthamapalayam is not much and it is hardly take one hour to reach Uthamapalayam to Madurai.

3. Accordingly, H.M.O.P. 107 of 2020 now pending on the file of the Judge, Family Court, Madurai is directed to be withdrawn from the said court and transferred to the file of the Subordinate Court, Uthamapalayam, Theni District.
