O R D E R

The present writ petition has been filed seeking a Mandamus directing the first respondent to issue passport to the petitioner based upon his application dated 09.01.2026 and the representation of the petitioner dated 01.02.2026.

The learned Government Advocate (Criminal Side) appearing for the second respondent brought to the notice of this Court that the petitioner has been implicated in a criminal case in Crime No.157 of 2024 on the file of the second respondent police, which has culminated in filing of an E-filing charge sheet on 05.04.2025 in P.R.C.No.15 of 2025 on the file of the learned Additional Mahila Judicial Magistrate Court at Nagercoil.

3. She further submits that the petitioner has been implicated in another criminal case in Crime No.337 of 2021 on the file of the second respondent 2/5

police, which has culminated in filing of a charge sheet in C.C.No.12 of 2025 on the file of the Judicial Magistrate Court No.1, Nagercoil. The petitioner has also been implicated in another criminal case in Crime No.466 of 2021 on the file of the second respondent police, which has culminated in filing of a charge sheet in S.T.C.No.1634 of 2023 on the file of the Judicial Magistrate Court No.1, Nagercoil. The petitioner has been implicated in another criminal case in Crime No.148 of 2022 on the file of the second respondent police, in which the investigation is pending.

4. Considering the above said facts, the petitioner is directed to approach the Judicial Magistrate No.1, Nagercoil in both cases, seeking permission of the Court to go abroad. In case, if any such application is filed the same shall be disposed of within a period of four weeks. Depending upon the order passed by the learned Judicial Magistrate No.1, Nagercoil, the first respondent is directed to proceed in accordance with law. 3/5

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
