Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying to grant an order of bail.

The petitioner was arrested and remanded to judicial custody on 22.01.2025 for the offences punishable under Sections 177, 419, 465, 468, 471 of the Indian Penal Code, 1860 (Act No.45 of 1860) and Section 12(1)(b) of the Passport act, 1967, in Crime No.69 of 2024 on the file of the respondent-Police.
3. The case of the prosecution is that Amalan, who is the petitioner's brother, applied for the renewal of his passport. When the respondent police visited the petitioner's house for an enquiry, he was not present at that time. The neighbors informed the respondent police that the photo affixed to the passport did not belong to the said Amalan but to the brother. The allegation against the petitioner is that he travelled abroad using his bother, Amalan's passport and stayed there for the past ten years. Hence, the complaint.
4. Mr.S.Palanivelayutham, learned counsel appearing for the petitioner, submits that the petitioner has nothing to do with the alleged offence. He further submits that he has been falsely implicated in this case. He however submits that he is ready to abide by any conditions to be imposed by this Court. He further submits that the petitioner has been in incarceration since 22.01.2025. Therefore, he prays for granting bail to the petitioner.

5. Per contra, Mr.R.Meenakshi Sundaram, learned Additional Public Prosecutor appearing for the respondent-Police, submits that the investigation is at the initial stage. Hence, he prays for dismissal of this petition.

Considering the facts and circumstances of the case and considering the fact that the investigation is at nascent stage and taking note of the fact that if the petitioner is released on bail, he may abscond and tamper with the evidence, hence, this Court is not inclined to grant bail to the petitioner.
