O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the first respondent to make sub-division and to issue patta to the petitioner in respect of her 25 cents of land, situated at Koduvilarpatti village, Theni District, in Survey No.149/2B, on the basis of the representation given by the petitioner to the first respondent on 30.01.2024.

2. Heard the learned counsel for the parties.

3. The petitioner submitted that pursuant to the rejection order passed by the second respondent, the petitioner preferred an appeal before the first respondent on 30.01.2024 seeking sub-division and issuance of patta in his name in respect of the aforesaid properties. However, no action has been taken on the said application. Hence, the present writ petition has been filed.

4. Learned Special Government Pleader, appearing on behalf of the respondents 1 and 2, submits that the petitioner's appeal would be considered on merits and in accordance with law. 2/5

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal dated 30.01.2024 on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

6. Such appeal shall be considered and disposed of after conducting an inquiry. The first respondent is further directed to afford a reasonable opportunity to the petitioner, the third respondent and to all other persons who may be affected by such decision during the course of the inquiry.
