PRAYER :- For Bail in Crime No.21 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner herein seeks bail since he was arrested in Crime No.21 of 2020 by the respondent police for the offence under Sections 147,148 and 302 of IPC.
2. The case of prosecution is that the accused persons to take revenge of the double murder of Veerachamy and his and son Muthu, has killed Krishnamoorthy who is one of the accused in the Veerachamy and Muthu double murder case. In the First Information Report, 18 persons were named. The name of the petitioner is not mentioned in the First Information Report. However based on the coaccused confession this petitioner has been implicated as one of the accused.
3. The petitioner herein contended that he is innocent and working at vegetable shop in Madurai and he has nothing to do with the alleged murder of Krishnamoorthy. Further he also contended that his name was not figured in the First Information Report and similarly placed accused by name Kannan was granted bail by this court in Crl.O.P(MD) No.3371 of 2020 on 28.02.2020.
4. The learned Additional Public Prosecutor opposing the bail petition would submit that due to rivalry between two group, the present incident had happened as a retaliation of the double murder occurred last year. Out of 28 accused 9 persons are still at large and if the petitioner is released on bail investigation will get https://hcservices.ecourts.gov.in/hcservices/
hampered and it will be difficult for the respondent police to secure the other remaining accused.
5. Taking note of the submissions made, this Court is of the view that the chain of crime causing threat to the public cannot be viewed lightly. Moreso, when few of the accused still at large, this Court is not inclined to grant bail to the petitioner.
