ORDER : The Court Made the following order :- The case of the prosecution is that due to election for the Primary Agriculture Co-operative Credit Society, Peraiyur, the scrutiny of the applications of the candidates took place on 02.05.
2018 and during the scrutiny process, there was a dispute between two groups. The petitioner found 2.On the side of the petitioner, it is stated that no one is injured. No weapons are used to damage the properties and the value of the damages was not stated in the complaint and prayed that the petitioner to be released on bail.
3.On the side of the respondent, it is stated that totally 10 accused are involved in this offence and the petitioners herein are accused 1 to 3. The complainant is the returning officer, who is the Government servant and the alleged occurrence was taken place in the Government Office. The petitioners are said to have trespassed into the office with deadly weapons. 5.It is the duty of the public to co-operate with the election process. The complainant is the returning officer and the petitioner prevented the returning officer from discharging his official duties and they caused damages to the Government office. 6.In the above circumstances, this Court is not inclined to release the petitioner on bail. Hence, this Criminal Original Petition is dismissed.
