ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal at the stage of admission itself. 2.The learned counsel for the petitioner submitted that he is blessed with four male children and his first son by name Karuppasamy, who has been taking care of entire family by his income, was brutally murdered, for which a case was registered and the accused were convicted. As the petitioner belongs to Schedule Caste, he has sent a representation dated 05.03.2019 seeking compensation for the death of his son and also a Government job for his son by name Ramar. As the same has not been considered till date, the petitioner has become with this writ petition seeking a direction in that regard. If the said representation is directed to be disposed of within a stipulated time, the ends of justice could be secured.

3. The learned Government Advocate appearing for the respondent submitted that the respondent would consider the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.4507 of 2020 representation of the petitioner, dated 05.03.2019, as early as possible.

4. Whenever a representation is made to a statutory authority to redress the claim of the employee, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. Such an inaction would amount to dereliction of duties and thereby this Court would be justified in invoking its extraordinary powers under Article 226 of Constitution of India and thereby direct such authority to consider the representation within the stipulated time.

5. In view of the above, this Court, without going into the merits of the case, directs the respondent to consider the representation of the petitioner dated 05.03.2019 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands disposed of. No costs.
