ORDER

The petitioner has filed this writ petition for a Mandamus, directing the second respondent to issue licence for conducting bar and collecting bottle in TASMAC retail shop No.11827 situated in Door No.38, Meenakshi Theatre Road, Rajapalayam.

2. The learned counsel appearing for the petitioner submits that the petitioner has participated in the public auction conducted by the respondent/TASMAC, where, he was declared as highest bidder. At the instance of a person, who could not succeed in the auction, the respondent/TASMAC has refused to give licence to the petitioner to operate the Bar.

3. The learned counsel appearing for the second respondent/TASMAC submits that a policy decision has been taken by the second respondent/TASMAC to close down the TASMAC shop No.11827, in view of public objection from that area.

4. Recording the submission of the learned counsel appearing for the second respondent/TASMAC, this writ petition is closed. If the second respondent is not intending to proceed with the TASMAC shop, the second respondent shall refund the earnest money deposit to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
