PRAYER:- For Bail in Crime No.12 of 2023 on the file of the respondent herein. ORDER:- The Court made the following order:- The petitioner is Sole Accused, who was arrested and remanded to judicial custody on 30.05.2023, for the offences punishable under Section 366 of IPC and Section 6 r/w 5(1), 5(j)(ii) of POCSO Act, in Crime No.12 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the accused had committed aggravated penetrative sexual assault with the victim / daughter of the defacto complainant. Hence the complaint.

3. Learned Government Advocate (Crl.side) submitted that charge sheet was filed before the concerned Court and taken cognizance in Spl.S.C.No.2324 of 2023. He further submitted that the earlier petition filed by the petitioner for bail, was dismissed by this Court.

4. In the above circumstances, the petitioner is at liberty to approach the concerned Court for bail. The trial Court may consider the petitioner's bail petition, without being influenced by the order passed by this Court in the earlier occasion.
