The present writ petition has been filed seeking a Mandamus directing the first respondent to grant a building plan approval pursuant to the petitioners' application dated 22.04.2022 without insisting for "No Objection Certificate" from the second respondent.

2. A perusal of the records reveal that the petitioners have purchased the property under a registered sale deed, dated 07.07.2000. The petitioners have created a mortgage by depositing of title deeds with regard to the properties on 12.05.2016. Thereafter, the petitioners have made an application on 22.04.2022 seeking building plan approval. However, the application is kept pending before the first respondent on the ground that the petitioners should produce "No Objection Certificate" from the second respondent Bank. Therefore, the petitioners have filed the present writ petition. 2/5

3. The petitioners have mortgaged the vacant site with the second respondent Bank by depositing the title deeds on 12.05.2016. Putting up construction in the vacant site will only increase the value of the property. Therefore, the question of obtaining "No Objection Certificate" from the second respondent Bank does not arise.

In view of the above said facts, the petitioners are directed to represent their application seeking building plan approval and the same shall be considered without insisting for "No Objection Certificate" from the second respondent Bank and orders may be passed within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above said observation, this writ petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
