For Respondent : Mr.Ss.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 1012 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 324, 307, 506(ii) r/w 3 of Tamil Nadu Property (Prevention of Damages & Loss) Act, 1992, in Crime No.1012 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is an Auto Driver. On 07.11.2021, at about 09.00 p.m, after dropping one Masilamani in his house, he found that his auto key was missing. When he enquired the same to the accused persons, who were standing near his Auto, the accused persons abused him in filthy language and brutally attacked him with deadly weapons and caused damage to his Auto. Hence, the complaint.

3.The learned counsel for the petitioner would submit that and the petitioner is innocent and due to the previous enmity, the petitioner has been falsely implicated in this Case. He would https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.4158 of 2022 further submit that this is the third anticipatory bail petition. A3 & A4 have also been granted anticipatory bail and A1 was remanded to the judicial custody. The change of circumstances is that, the petitioner is the sole bread winner of his family and his family is in very indigent circumstances without any source of income. Hence, he seeks anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the State would submit that earlier anticipatory bail application was dismissed by this Court on the ground that the petitioner is having bad antecedents and he is having 8 previous cases. Noting that the case of assault and murder, it was dismissed on 31.01.2022. 5.Considering the submission made by the learned Government Advocate (Crl.

Side), Since the offence is involved under Section 307 and 324 of IPC, the petitioner is directed to co-operate with the Enquiry Officer to complete the investigation. 6.Absolutely, I find no change of circumstances and no merits in this petition. This Criminal Original Petition deserves dismissal and accordingly, the same is dismissed.
