ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to consider the petitioners' representation dated 12.01.2026 and consequently, forbearing the first respondent from disbursing the compensation for acquisition of the subject properties in Survey Nos.4 and 5, Ramankulam Village, Madurai South Taluk, Madurai District to the respondents 2 to 10 pending disposal of the appeal in A.S.No.148 of 2014, on the file of the Principal Subordinate Court, Madurai.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Since no adverse orders are going to be passed against the respondents 2 to 10, notice to the respondents 2 to 10 are hereby dispensed with.

The learned counsel for the petitioners submits that the first respondent has issued a notification for acquisition of lands for the expansion of the Madurai Airport, wherein a portion of the lands comprised in S.Nos.4 and 5 are sought to be acquired. It is further submitted that there exists a serious dispute with regard to the title to the subject properties between the petitioners and the respondents 2 to 10. In this regard, civil litigation between the parties is pending adjudication before the competent Civil Court, and the appeal in A.S.No.148 of 2014 is pending on the file of the Principal Subordinate Court, Madurai. In view of the pending title dispute, the petitioners submitted a representation dated 12.01.2026 to the first respondent, requesting that the compensation amount for acquisition of the subject properties shall not be disbursed to the respondents 2 to 10 until final disposal of the said appeal. However, despite receipt of the said representation,
the first respondent has not considered the same nor passed any orders thereon till date. In such circumstances, apprehending wrongful disbursement of compensation to the respondents 2 to 10, the petitioners have been constrained to approach this Court by way of the present Writ Petition seeking appropriate directions forbearing the first respondent from disbursing the compensation pending disposal of the civil appeal.
5. The learned Additional Government Pleader appearing for the first respondent would submit that the petitioner's representation dated 12.01.2026 will be duly considered before disbursement of the compensation amount, and appropriate orders will be passed on merits and in accordance with law.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioners' representation dated 12.01.2026 prior to disbursement of the compensation amount, and to pass appropriate orders on merits and in accordance with law, after affording reasonable opportunity of hearing to the petitioners, the respondents 2 to 10 and any other persons who may be affected by such decision, within a period of sixteen weeks from the date of
receipt of a copy of this order. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. NCC : Yes / No (K.SURENDER, J.)
