ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police in Crime No.40 of 2015, on the file of the respondent police for offences under Section 379 I.P.C @ 147, 379 r/w 109 I.P.C, the petitioner is now before this Court seeking Anticipatory Bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate(Crl. Side) for the State.

The respondent police have filed a status report, in which in Paragraph No.1, they have stated as follows: "1.I submit that on 08.02.2015 at around 11.00 hrs the petitioner namely K.P.Muppudathi, S/o.Poosaipandi residing at Veriyan Kovil Street, Kadayanallur who submitted a petition regarding that he has working as Engineer in m/S Shriram EPC Ltd. and his company has claimed a contract work from the Tamilnadu Water Supply and Drainage(TWAD) Board to lay the water pipes from Kodrangulam river bed to Kizhapavoor village. He has performing the duty to look after the pipe laying work along the road side in the allotted area and he placed the Iron pipes on the road side for inlay for his day today work. Further he stated that on 02.02.15 he has been placed by the company to look after for laying the pipes at Muthaliyarpatti Gandhinagar side and he has been placed https://hcservices.ecourts.gov.in/hcservices/

91 pipes iron pipes with a mark of 250 mmD1 at Muthaliyarpatti Gandhinagar Mosque after completion of that day work. On 03.02.2015 morning Petitioner noticed that 71 pipes value of Rs.700000/- which were stolen by some unknown culprits and he enquired in and around the area but all in vain so that he lodged the above complaint. Further a case was registered based on his petition vide Crime No.40/15 in Kadayam Police Station by Tmt.Meeralbanu Woman Sub Inspector of Police."

4. Involvement of this petitioner has been disclosed in the statements of the arrested accused.

Taking into consideration of the serious nature of the allegation against the petitioner, this Court is of the opinion that this is not a fit case to grant anticipatory bail to the petitioner and hence, this Criminal Original Petition is dismissed. sd/- 05/03/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
