ORDER

The petitioner seeks issuance of a Writ of Mandamus to direct the respondents to correct the wrong classification of the land in the Village Revenue Records as Sarkar Grama Natham and regularise the possession of the petitioner.

2. According to the petitioner, the lands are Grama Natham lands and the petitioner has been in continuous possession and enjoyment. However, in the year 2023, the sixth respondent has taken advantage of the wrong classification reflecting the subject lands as Sarkar Poramboke Grama Natham and destroyed the hut put up by the petitioner and started construction activities. The petitioner thereafter, approached the 2/5

authorities seeking information under the Right to Information Act and subsequently, has come forward with the present writ petition.

From the typed set of papers filed in support of the writ petition, this Court is unable to ascertain as to the length of possession or even the factum of possession being with the writ petitioner for him to become entitled to assignment of Grama Natham lands under the Nathan scheme. However, considering that the petitioner only seeks for a Writ of Mandamus, the petitioner shall make a detailed representation to the third respondent and the third respondent shall give an opportunity of personal hearing to the petitioner and ascertain the entitlement of the petitioner to seek rectification of the revenue records from Sarkar Poramboke Grama Natham to just Grama Natham lands. The entitlement of the writ petitioner shall be considered by the third respondent on merits and in accordance with law, after giving an opportunity to the petitioner. The said exercise shall be carried out within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition is disposed of. No costs.
