ORDER

The Contempt Petition has been filed to punish the contemnors for their wilful disobedience of the order passed by this Court in W.P. (MD)No.20768 of 2024 dated 02.09.2024.

2. When the matter is taken up today, in pursuance of the direction of this Court, the contemnors are present before this Court. Counter affidavit of the first contemnor filed. They have also produced the copy of the closure report of the petitioner's complaint.

It is not in dispute that the property in dispute is an ancestral property of the petitioner's father and according to the learned counsel appearing for the petitioner, the petitioner's father alienated the property without the consent of the petitioner and by alleging that his father committed fraud, the present complaint came to be lodged.

4. The learned Government Advocate (Criminal Side) appearing 2/4

for the contemnors would submit that the investigating officer, after taking note of the pending of the civil suit and also the pendency of the proceedings before the Registrar, directed the petitioner to workout his remedy before the concerned Court as well as before the Registrar. Even according to the learned counsel appearing for the petitioner, suit for partition has already been filed and the same is pending.
