ORDER : The Court Made the following order :- The petitioner is in judicial custody since 31.06.2018 for the offences punishable under Sections 417, 376, 294(b), 506(i), of IPC, in Crime No.11 of 2018 on the file of the respondent police. He seeks bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The case of the prosecution is that the petitioner had sexual intercourse with the defacto complainant and also promised to marry her and received a sum of Rs.80,000/-. Thereafter, he refused to marry her and also did not repay the said amount. Hence, the complaint.

4.The learned counsel for the petitioner would submit that the petitioner is aged about 30 years and the defacto complainant is aged about 35 years. They lived together for the past seven years. The complaint has been foisted as against the petitioner for the reason that the petitioner did not repay the amount borrowed by him. He further submitted that the petitioner is in judicial custody from 31.06.2018 onwards. Hence, he prays for grant of bail to the petitioner.

5.Considering the above facts and circumstances, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ramanathapuram, Ramanathapuram District. (ii)the petitioner shall appear before the respondent police daily at 10.30 a.m., for a period of two weeks. sd/- 16/08/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
